Divorce

Wisconsin Divorce Law

Divorce is the legal process to dissolve a marriage. In a Wisconsin divorce case, the divorcing parties, with assistance from their Wisconsin family attorneys, determine the best way to resolve issues of legal custody and physical placement of children, child support, maintenance (alimony) and property division. At Gagne & O'Halloran, LLC, we are aware of the trauma divorce can cause parties as well as their children. We provide different approaches to divorce, depending on the client as well as the facts and circumstances of the particular case. These approaches include traditional divorce, cooperative divorce and collaborative divorce. At Gagne & O'Halloran, LLC, we are experienced in all methods of providing Wisconsin family law services. We will meet with you to discuss the facts and circumstances of your case and help you to determine the best process to resolve your issues.  In addition to divorce actions, we represent individuals in paternity proceedings and other legal actions that involve the family.

Traditional family law in Wisconsin

Traditional family law proceedings are based on an adversarial model, which begins with an exchange of information and negotiations.  Issues that are not resolvable through negotiations are presented to a court to obtain a final decision.  Like other processes, our goal at Gagne & O’Halloran is to effectively negotiate a fair and reasonable resolution.  However, if issues are not resolvable through negotiations, we are experienced and effective litigators and will represent parties in court proceedings.

Collaborative family law in WisconsinCollaborative Divorce Wisconsin

Collaborative family law attorneys need special training.  In a case that proceeds in a collaborative manner, attorneys and parties, together with other professionals as needed, work together in a cooperative and non-adversarial process.  The goal is to reach a settlement that provides the greatest benefit for all family members.  Attorneys and parties sign a written agreement to voluntarily disclose all financial and relevant information and to proceed in a respectful way toward settlement.  Cases often proceed with a series of four-way meetings and include, in some cases, the use of other financial specialists, child specialists and mental health providers.  The parties are directly involved in the process and serve as architects of their final agreement.  For more information regarding Wisconsin collaborative family law, please visit the Collaborative Family Law Council of Wisconsin.

Cooperative family law in Wisconsin

Cooperative family law is a process of handling family law issues which is settlement-based but leaves open the possibility of litigation if and only if absolutely necessary.  The process sets a framework for settlement, minimizes inefficiencies and costs, promotes cooperative co-parenting, and fosters civility and respect.  Unlike collaborative family law practice, if litigation becomes necessary, the parties may keep the attorneys who have represented them throughout the negotiations.  For more information regarding cooperative family law, please visit the Divorce Cooperation Institute.
